Introduction
 

The tasks of the Commissioner for Fundamental Rights related to the operation of the CRPD Independent Monitoring Mechanism are performed by the Directorate-General for Disability, which operates at the Debrecen site of the Office of the Commissioner for Fundamental Rights of Hungary, more precisely, at the Department for Disability Affairs set up within the Directorate-General.

In the frameworks of this, the Commissioner for Fundamental Rights

  • shall monitor the enforcement of the general principles and obligations set out in the UN Convention on the Rights of Persons with Disabilities (CRPD), as well as their system-level application,
  • shall examine to what extent social consultation is realised, and to what extent civil societies are involved in decision-making,
  • furthermore, shall monitor the fulfilment of the obligations arising from the individual articles of the Convention and wherever he identifies a missed action or impropriety, he shall formulate proposals for more efficient implementation.

The responsibilities of the Commissioner for Fundamental Rights regarding the implementation of the Convention include but are not limited to the following:

  • handling individual complaints;
  • providing information and advice on the rights and obligations of persons with disabilities, their family members and carers;
  • examining equal access to services;
  • monitoring the operation of in-patient and residential social institutions, as well as the circumstances of the residents thereof;
  • exploring the circumstances of groups with multiple disadvantages, with special regard to women and children with disabilities.

The Commissioner for Fundamental Rights prepares a comprehensive report on the performance of the tasks of the Independent Monitoring Mechanism every year, which shall be disclosed on the homepage of the Office.
